    I think legally you HAVE to return any money paid to you for services you have NOT provided minus whatever is owed for the required notice period.

    Some providers require a two week notice and some require a month. If a family pays you for a whole month and gives a two week notice per your contract agreement, then you would have to refund the remaining balance as you didn't do anything to earn it.....kwim?

    I made the comment to Daisymomma because she said the family paid for a month in advance but I assumed she only required a two week notice so if that is the case, she would have to refund them the remaining balance.

        Unless the provider had the parent sign a statement acknowledging that any funds above and beyond the required weekly/bi-weekly/monthly/etc fees were non-refundable than I think legally and morally, the money should be returned.

        I once had a parent want to pay me the whole years fees! I told her that I would only allow it if she signed a disclaimer that she understood that if childcare services with me ended for any reason before the year was up that no fess would be returned... I'm not a bank!

          I'm going to do this from now on. Do you have a disclaimer written up that you can email me?

            I would return any unpaid money (over the amount required for termimation notice) automatically, I was just wondering. I would never want to keep money over what was rightfully mine Just curious why the parents wouldn't just give notice rather than wait out the prepaid period, if they could get the extra money back, KWIM? That's assuming that they will terminate- which it sounds like OP is hoping for anyway! Well, good luck with the situation, I hope they don't do anything underhanded like try to falsely report you for being over ratio or anything! Hope it all works out!

              So far DCK is a no call no show today. Arrival is 830, its now 920. Mon. They showed at 915 though. Naturally I'm awaiting their arrival outside :: its 43 right now.
