How is it price gouging if the client agrees to the fees? They can go somewhere else if they don't want to pay increases. It's not like you're the only daycare in town.
This would be my request as well. There's no regulations about prices and customer service last time I checked! And what would licensing have to do with that anyway?? It could just be a reason for licensing to come out anyway but I can't imagine that actually being on your record or anything.

It usually takes about 6 weeks before they finally realize that the provider really DOES intend to get her money...and so they call licensing with trumped up complaints. Licensing are then happy to tell them "Too bad...so sad...times up" A LEGITIMATE claim is usually filed straight away.

If the dept. find that a complaint was malicious...they file charges.

"By statute, the Department is not allowed to investigate an anonymous complaint. The statute also does not allow us to investigate complaints that allege incidents which occurred more than 6 weeks prior to the report of the incidents.

By submitting a complaint, you acknowledge that the information you submit is accurate. If a person knowingly gives false information to Child Care Licensing for the purposes of changing the status of a child care license or certificate, the person giving the false information may be guilty of a Class B Misdemeanor."

Complaints will still happen of course, but it's nice to know licensing has our backs at least a little bit.
      Oh, I am so jealous!
Other states need to catch on to this!

I'm wondering if child care providers could start a petition to make this law? I'm always getting emails from sites like move on.org and such to start petitions.

Licensing report said it was unfounded. This parent also took to social media & made libelous statements against my business. I sent her a cease & desist letter to which she continued. I sued her in small claims for the daycare fees & libel. I received a judgement & $1500 was for the slander & libel statements. She has a $92 reminder coming out of her paycheck each week to not be vindictive.

                      ........That's fantastic!

I remember your post with this letter. I copied it to have for reference, it was so good!
I would have no clue where to begin on something like that, never mind what our rights are.
                      Thanks Coolconfidentme!

Holy Moly! You guys are amazing. A few details:

I planned on sending the termination letter with a BCC to my coordinator to cover myself originally. I was mad I couldn't that before she filed the complaint. I did send it that night.

From what I am told she will have an option of a sit down interview to address her issues. I was told to have prepared any records of accusations, which I have.

I don't feel comfortable going over all the details, but what is most frustrating is that I live in a very small community. I see this family very often. This should not hurt me professionally, but it always smarts to have a nick in my history.

I don't think it is with me. Just my coordinator and/or her supervisor. Once this matter is laid to rest I will be sure to let you all know what happened. For now, I forwarded a few items that related directly to the incidents.

I live in a small town & my only advised is to own it. The other day while going into the store a DCM I termed was coming in behind me. I stopped, opened the door for her, smiled & told her to have a good day. I really wanted to trip her, & step on her as I walked in, .

Yep. The cease/desist letter speaks volumes in court. I filed to have her wages garnish & she THEN made a few $20 payments. I asked the judge for garnishment by the Indiana Code.., which turned out to $92 a week in her case.
