    More than likely yes because a OWI (operating while intoxicated) although a felony it does not in any way pose a danger or threat to the children in care. If he were to have child abuse, child endangerment or other such charges then your daycare provider could be denied to have him move in. In some situations she could still allow him to live in the home but not present while the daycare children are present such as for drug charges.

    If her boyfriend were to have had children in the vehicle and he were charged for that as well then perhaps your childcare provider would not be able to have him live in the home or at least not around the children.

    If you have questions about this you can contact your local licensing office and see if he is able to live there. In most cases you must have all adults living in the home go through a background check and be approved through licensing to be able to live in the home in order to keep your license. Some areas only require provider's to be registered and follow different regulations. Contacting your licensing office can answer all of your questions. If you still don't feel comfortable having your child in a home with someone that has had a OWI then you can always opt to choose another childcare provider.

      Would you happen to know anything that would cause anyone to be denied a daycare license like a felony if misdemeanor in Kansas.

        In Illinois you can't have a felony or crimes like assault, rape, child molestation ect it's pretty lax here with that. Who do you call to get your record expunged? I have a property distraction from back in 1998. I broke my anger management councilors desk lamp.

          It is possible to get your record expunged but to do that you need to contact an attorney. Your attorney will know what to do and who to contact. I know someone that had a DUI from 10 years previous be expunged and all they needed to to was have a clean record since then. That person also participated in AA meetings and his AA support person and counselor wrote him character letters but he had an attorney to do all the heavy legal work.

          Personally I wouldn't try to do it on your own. If you try yourself and don't properly show your case and get denied it might make it much harder for you to then get an attorney try to do it for you if only because now you'll have one denial in your file. It works different in different states though.

            Thanks I may look into that tomorrow. I actually was denied a cleaning job because of that 1 thing on my record yet I can watch kids for a living. Doesn't really make sence. I want a part time job outside of home, preferably cleaning offices or something. No people to deal with

              Misdemeanor, persistent disorderly conduct

              I had a domestic violence charge over a year ago that was dropped to a persisten disorderly conduct. I have to go through an BCII/FBI background check. Is this going to disqualift me from getting the job at the daycare?

                In Iowa can you work in a daycare center with a misdemeanor with a position of a controlled substance? It's been 3 years since then. I just need to know if you can work in one with something like that on your record. It doesn't have anything to do with children or anything.

                      I had a misdeameanor simple poss. Charge in the past. Would this disqualify me from licensing a daycare in Tn?

                        HI, I am ready to get clearance to get a Child Development Permit License. However, I am scared to dead. In 2010 I got charged with shoplifting for some chocolates. I know, the worse decision I have ever made in my life ~ literally . I hunts me everyday and I regret every bit of it.

                        When we got the forms, the lady mentioned that if we had something in our background such as shoplifting, DUI and we had a child with us, the license would be denied (she said: "child endangerment"). She gave us an example of someone that had a DUI and had a child in the back of the car. She did not give an example of shoplifting and I didn't want to ask because I thought everyone sitting in that room would know I was talking about me... and you know, I feel so ashamed that I don't want to tell more people other than the one I absolutely need to tell.

                        Anyway, I was indeed with my child. She was 3 months old at that time (May, 10, 2010 @ 3 pm). After going to court, I got charged with an "infraction". It was a conviction because they said I was guilty (which I was indeed). They didn't give me a misdemeanor, like I said, an infraction and I paid a fine... other than lawyers fees (which the $6.95 amounted to thousands of dollars, let along with immediate family horrible judgements that still are with me... and the fact that it has been hard to forgive myself).

                        I live in California.

                        My question is, do you know of a similar case that this person was granted the license or was denied? I would like to open a pre-school center... but I will start with a home care for a bout a year if everything would work well.

                        P.S. I must add, I did this when I was older (not a child), which makes it even sadder.

                        Please let me know, something you must know.

                          The only way to really know is to submit your application and go through the process. You MUST be honest about it. If you are not, it can be an automatic denial. I actually know someone that didn't disclose something and they got denied based on withholding the information, so just be honest and hope for the best! The fact that you had the child with you may be enough to deny you to be honest, but you will never know if you don't try!

                            I would list the infraction whatever it was deemed by name as from the court. Did the infraction list that your child was with you?

                            I'm thinking she meant DUI with a child and not shoplifting withy a child. DUI with a child IS child endangerment. Shoplifting with a child doesn't ENDANGER a child.

                            Regardless, I'll keep you in my thoughts. I can tell this is difficult for you.

                              Thanks both for replying.

                              Yes, I read the pdf file that my lawyer had sent me (I have all that information saved). The document says I was with infant daughter "name, lastname". I tell you, reading that document again was about to brake me down in more pieces. I kind of feel I am getting sick of my stomach.

                              But you are right, my mom always says there is not worst diligence than the one that we don't do, so I will try. I will be honest for sure.

                              One of the forms asked if I have ever been convicted of something... so I checked the box that says "yes". It says misdemeanors/felonies. However, there is not a space to explain or write something about the nature of the conviction. I am meeting with my instructor next week. She is handling the forms. Again, another person that will know what I did. I wonder if I will ever be able to recover from this. I feel really down right now. We'll see what happens.

                                If this can keep me from being employed at a daycare center?
                                I was offered a supervisor position but someone told me that the charge
                                Will keep me from being employed.
