It probably depends on how recent the charge is. I believe my state only looks at child abuse/neglect charges, and disregards criminal charges if they even look at them. I THINK. I don't remember being asked for anything but a release to check the child abuse registry.

I live in Illinois and have an associates in early childhood. I currently work at a daycare but I am thinking about opening an in home. But I now have a dui charge ( but not convicted ) on my record. I am on court supervision so I will never be convicted but the charge will always be on the record. Will this keep me from being able to get lisenced
IIRC, in my state a DUI would only affect your ability to offer transportation.- Flag

I am currently taking a director course and is wondering if my record will cause me any problems to open my own childcare facility. I was arrested in 2008 for petit theft and I was able to just take some class because it was my first offense, after that I expunged that record. Now in 2014 while 8 1/2 months pregnant I was charged with domestic violence-charges were dropped. But, my fear is will I be able to open one with these two things on my record? My record came out clean, my husband who will have nothing to do w/daycare or be there when children are there because of his work has few DUI's under his belt from 20 years ago. There's a hold will this affect me from receiving clearance to my daycare license. So unhappy in California....- Flag

I do know that if you are approved but your husband or other adult in the home is not you have the option to appeal or to apply for a variance. If approved for a variance you can still get a license with the condition that whoever it was that was denied not be present at all when daycare children are present. I do not know much more on this however and really your best bet for answers on how this all works is to call licensing directly to ask them.- Flag
