Advice Needed on Ratio Issue

    Ok, I just reread the ages. You will have a 3 1/2 mo, a 10 mo, and a 23 mo - that gives you your 3 infants. The two new kids are over 2. Your own kids are 4 1/2 and 7. That will give you 6 kids plus 1 SA. You will be within your license.

      If you want to take more than the number allowed for a small LIC.,. you then have to apply for a large LIC first. You have to go through a fire inspection and another inspection by LIC. Your home has to be improved first and you will have to have an asst. present any time you are over your numbers for a small LIC.

        Ditto... yes you will be ok... its under 24 months

            No. She can only have two under two years if she has more than 6 children, regardless if one is school age or not.

            You would NOT be over capacity if one of your children were to go visit family or goes to daycare for those two weeks. It would look like this:

            6 children, 3 under two years old. Legal -

            3.5 month
            10month
            23 month
            2years
            2years
            4.5 years

              (a) The capacity specified on the license shall be the maximum number of children for whom care can be provided.

              (b) For a small family child care home, the maximum number of children for whom care shall be provided, including children under age 10 who live in the licensee's home, shall be one of the following:

              (1) Four infants; or

              (2) Six children, no more than three of whom may be infants; or

              HANDBOOK BEGINS HERE

              (3) Health and Safety Code Section 1597.44 states:

              A small family day care home may provide care for more than six and up to eight children, without an additional adult attendant, if all of the following conditions are met:

              (A) At least two of the children are at least six years of age.

              (B) No more than two infants are cared for during any time when more than six children are cared for.

              (C) The licensee notifies each parent that the facility is caring for two additional school age children and that there may be up to seven or eight children in the home at one time.

                  So bottom line if either my own 4.5 yr old or my 6.5 yr old are not present during open hours I will be fine during those 2 weeks? Correct?

                      In my state you could file for a variance and I would think it would be granted since it is for just 2 weeks.

                            Call your licensor and ask. I am guessing you would be fine for two weeks- but laws are different. Are you due
                            for an inspection? I would have an assistant come in and help you, instead of sending your kids out. Every state does things different so you should just give them a buzz on the tele and explain your dilema and ask. Curious how you will make out.

                              This would not work in Ca. They do not allow over capacity AT ALL. An assistant would make no difference. Even if it would, she wouldn't have time for background clearance, cpr, etc.
