Abnormal Behavior Of Daycare Owner

Greetings!!

Here I am sharing my experience on last week and sharing with you guys to get inputs to proceed further.

My toddler goes to a home day care in the neighborhood and two weeks ago we gave the notice that we are pulling her our. After passing 1.5 weeks (3 days before to ending the contract), we went to pick up our daughter and we did see there was a different pant on her. As usual we asked owner, what is she wearing? Instead of answering or clarifying why some other clothes on our toddler,owner started yelling at us, you guys are sensitive parents, you are going in two says why are you asking questions and asked about final payment. We said we already transferred, please check your bank account. The moment the owner knew the money transfer information, she abruptly said, don't bring your kid tomorrow on wards and I am not willing to allow. And ran into the rooms banging the doors and shouting of the other kids searched for our toddler belonging and shouting at us. We really feel its not acceptable behavior and would like to check with all other parents about the further proceedings. More over we have planned for a vacation for 1 month and owners behavior really spoiled our excitement about the trip and left us in trauma " whats happening to us?" . Today when I call to ask for the money, Owner's husband is taking the call and saying do what ever, we are not paying back. First of all whats his business to talk to us and his name is not there in the contract. I would greatly appreciate your responses and inputs for further proceedings about the daycare. Our stress was , our daughter is kind of shocked and other kids as well while the owner was shouting.
Owner was blaming us that we are forming groups between the parents and etc. Whats her business if we form as a group or anything. We form because kids can have play dates and its easy to handle and share the play dates. She doesnt like to answer any question from parents. Apart from this some one wrote a bad review and she was blaming that my wife wrote that. Honestly we never did that. Its really putting us in a deep stress.

So she kicked you out three days before the end of the contract and you are trying to get those three paid days reimbursed because she will not allow your daughter to attend? am I reading this right?

I assume that the daycare contract backs up your claim that she is required to provide care during the two weeks notice period. What does the contract say regarding her keeping payment if she has terminated care on her end? If you have a right to the reimbursement, you also have to consider if you really want to pursue this money and deal with this person any further. Likely your only option will be to pursue this in small claims court.

If she is licensed, you can certainly report the situation with your concerns over the CARE of your daughter and other children. I wouldn't even go into the money situation as more than likely, the licensing agency will not get involved on that part of it. If you have seen inappropriate behavior from the provider, you have the right to report that and let the agency decide if an investigation or inspection needs to be done.

Thanks for your valuable input. We are not worrying about the money and no plans to get it. The only thing bothers us , shouting at us,kids and abruptly throwing us out immediately after the final payment. Its really stressing us so much and a day before our long vacation. We strongly don't like her talking about other parents and other kids to us. Its purely gossiping and we strongly told her, just to talk only about kid and what should we care with our daughter. Yes, kits a licensed day care and there is a contract between us. The only termination term in the contract is " failed to pay the fees will cause immediate termination". We never failed in this scenario. Our honest opinion is, if you are running a business like day care, you shouldn't show your personal emotions and irritations on kids and parents. And gossiping about parents and kids is an unacceptable behavior. I called the cops and asked for my options to pursue, They also suggested like you to lodge a compliant with the department of state and small claims court.

Things cary from state to state, but where I live, the state can't really dictate or control business operations. They have rules for the healthy and safety of the children, but each daycare's business policies are out of their hands, no matter how poorly business is handled, as long as it doesn't violate any of the daycare licensing standards - it is out of their hands. More than likely the daycare licensing specialists will tell you whether they can pursue an investigation based upon your claims. From what I know, I would doubt that they have any jurisdiction over your complaints - they just sound like poor business practices. Small claims court will probably be able to help you, but for 3 days fees, it might not be worth your time.

As far as her talking about other families and children with you, while it is unprofessional, you have to remember that she lacks co-workers to lament and talk about each day with. Most people have their work friends who they can talk about their work with, daycare providers don't. While it is unprofessional, I have definitely let things slip or vented to other parents about other families in a moment of frustration. NOT saying it's okay, but it just happens sometimes.

Don't let this stress ruin anything for you, especially a vacation.
