I thought she was pushed by someone? Did she really fall and that is why no one saw it? I don't think the school is going to be responsible in the long run because it doesn't sound like anyone can get the correct story.

The whole sidewalk being in disrepair would be odd do because it seems like they would have had alot more injuries than just one if it is that bad? We had a sewer pipe break at our school and the entire student body or at least 95% of them became sick before we actually found out what was the cause of it.

Sounds like you need to do some deeper digging for the whole story!

I too am sorry for your daughter, OUCH!

On the other hand, I agree with Silver.....stuff happens. It COULD happen at daycare....and I think a 1 to 15 ratio makes it quite probable that none of the adults would see it happen. I would not want a parent coming after me because I did not see an accident on the playground....and even if I had seen it, probably could not have prevented the injury anyway. And, generally, NO, you would not be held liable for the cost, unless they sued you, and even then they would have to prove negligence on your part.

I know here in Cali. we have to sign a document at the beginning of every school year that states the school is not liable for accidents of this nature. If it is something caused due to sheer negligence on the school's part then we can request or sue for compensation, but general accidents are not covered by school insurance.

I have the same rules as the schools do here in CA. This way one it gets the children used to already following the rules and two so that I am free of too much liability.


I tell parents this in the interview and really encourage them to take their children to the park or to play outdoors so that they can play any way they want.

I feel bad that this happened to your child, but the sad part is that as much as this stinks, stuff like this happens everyday at schools.

Kids will be kids and they will get hurt....

Does the school by any chance have video cameras for the playground?

Also if your DD can identify the culprit, has the school even talked to them? I would think they were playing near others or perhaps with friends so there are supporters of your DD version of what happened.

I would hope that maybe if there are collaborating stories, the "pusher's" family could be held responsible for part of your deductible.

I think it should fall on the "pusher". If she is being pushed down look into if it"s the same person (s). If it is and it's a bully issue, then it needs to be dealt with. If it's not, then chalk it up to an accident and see if the school can help out in any way. ((((HUGS))))
