If my son and his child move home do I have to claim the infant in my ratio if I am not providing care for him?

Depends on where you live. I am in Minnesota and the baby would have to be included in my count. -

I think here in Ca. they don't count as long as that parent is home to care for the baby. But, be careful if they need to run to the store because that's when licensing will show up:

Also, remember that your son will have to have a background check done. If he is residing in the home he will have to do this.Each day is a fresh start

Nope not true. I'm in CA and I can't even have my nephews over to visit even if his mom comes and is watching him if it's during daycare hours and I am at max capacity much less if he's living here. I know, it doesn't make sense to me either but it is what it is.
When my SIL split with her DH we had an extra bedroom that she was interested in renting from us. It was a large bedroom so her and two kids would have lots of room. I called licensing to ask about it and they said her kids would count even if she was home and if it put me over my capacity. My BIL (living at his moms house at the time) and SIL ended up having to switch, he moved in here and has a big bedroom to himself and she and her two kids had to move into her mothers place and stayed in a 10x10 bedroom for a year. All three of them!! Nuts I tell you.Comment

oh, ok I guess I was just remembering a lic. rep tell me that if you have a friend visiting(fingerprint cleared) and she needed to run to the store she better take her kid with her, I guess she was saying if that child would put you over 8 by yourself.
You would think as long as that child's parent was there to care for them it would be allowed! never been in that situation.
Oh and now I see how someone can take advantage too.
If lic. shows up and there are 20 kids there... the provider can say,"oh those are all my nieces and nephews and my sister just left to buy food.
I guess it's a good rule.Comment

yes this is true.... I asked LIC about my own child, because he will be going to preschool soon and I want to fill his spot with a part time child. My husband will be home in the morning and will be the one taking my son. I was asking if I were to fill his spot and I had another child to fill the spot here for even 5 min at the same time, they said NO. they said that I could not even be above my capacity for 1 second, even if my husband and kid were just putting shoes on to head out the door.......
also, you can never go above 8 children in CA if you are on a small capacity license. Even if you do have a helper. If you want more than 8 children, then you need to apply and get approved for a large capacity license. then you can have more than 8 children , but then must have an approved helper there at all times your capacity is above 8..Comment
