I have 10 kids registered for next school year and my friend's son who is 14 years old wanted to be an assistant . Can I hire him and pay?

I don't know about your state regulations, but in mine you could hire him as your student assistant (someone who's 14-17 years of age). He can never be left alone with the children or left in charge even while you go outside for just a second. But as long as you are with him at all times, in my state he could work there. Of course the usual minimum wage laws would affect him, and the number of hours he can work and all that would affect you, too. Just curious, if this is during the school year that you'd need his help, would he even be available during the hours you need him? Our busiest time at our daycare (where it requires two people at least), is during school hours. Most daycares are like this, I'm sure, unless they focus mainly on before/after school care. Afternoons are really low ratio here and one of us can usually go home after the children are all napping, or at least after pm snack at 3:00.- Flag

102416 PERSONNEL REQUIREMENTS
(a) The licensee shall provide each employee with a copy of the Notice of Employee Rights (LIC 9052 (4/88)) form furnished by the Department.
(1) Each employee shall be requested to sign and date the notice form acknowledging receipt.
(2) A copy of the signed notice form shall be retained in the employee's personnel record.
(3) If the employee refuses to sign the notice form, a dated notation to that effect shall be retained in the employee's personnel record.
(b) A claim by the employee alleging the violation by the licensee of Section 102416(a) shall be presented to the licensee within 45 days after the action as to which complaint is made and presented to the Division of Labor Standards Enforcement not later than 90 days after the action as to which complaint is made.
(c) The licensee and other personnel as specified shall complete training on preventive health practices, including pediatric cardiopulmonary resuscitation and pediatric first aid, pursuant to Health and Safety Code Section 1596.866.

I also found somewhere in your regualtions that in california a 14 year old would be considered an assistant provider (anyone 18 or older is an adult caregiver). I didn't find anything else on it, regarding whether he could be alone with the children, but I'm almost positive he wouldn't be allowed to. Not that it affects you, anyway, since he'd just be helping you with their homework (that's a HUGE load taken off right there I would imagine!), and helping you with them outoors for their physical activities. A 14 yr old boy should be able to give lots of help in that area! So, it sounds like it will be a very very good thing having him there. Just make sure you are still in ratio even when he's not there (like before school, if he's not there, but all the children are) or any other time during the day when you have the children, but not him. If you aren't counting him in your ratio anyway, then you're good to go, it sounds like, as long as you follow the above section I posted! And all your local labor laws, of course.
That's great that you already have so many children enrolled for next school year! We're trying to fill up our many open spots for this summer, and not having any luck. Let alone next school year!- Flag

Yes, in California your assistant can be 14 years old. That is the youngest age they allow. Not that I would recommend a full-time job for a 14 year old in child care. I have, in the past, when my own children were over that age allowed them to work for me, but I always have another person here as well. Also, he can never be left alone with the children, the primary licensed provider must always be present.- Flag

This is a great question! I'm glad that the licensing aspect was answered as I am also in CA and a friend of mine has a daughter also 14 who is our babysitter on weekends and I was also thinking about letting her come once or twice a week during summer vacation to help out.
I know that the minimum wage thing would be necessary but what about the rest? Like I'm assuming that the paperwork would need to be signed by her parents since she's a minor, and what about workers comp and taking out for SSI, taxes and such? Anyone have An idea?- Flag
