    Do You Think This Is Fair?

    So I have a family that has been with me for a long time. They took their child out over summer and came back in the fall. I was able to find a child that needed summer only care so it worked out.


    DCM work schedule changed and now needs care outside of my business hours that I am not willing to work with.

    At the start of this month DCM came to me and told me the issue at hand and they might need to give notice, she gave me a heads up. Her boss let her work from home for 2 weeks to see if working the rest of her work day from home would workout for her supervisor, but it didn't.

    So DCM tells me yesterday that she just had the meeting with her boss and the boss says she can not work from home anymore that she will need to be in the office and therefore is going to have to give notice.

    I tell dcm please be sure to follow our contract and put it in writing. I told her that I understand that they will need to leave as of next week and will not be able to attend during that time so I would be willing to release the 30 days of required payments ONLY if i could find someone to take her child's spot. The child is full time.

    AND of course last month I passed on 3 families in search of full time care, but needed it immediately.


    Normally I would just say NO, follow the contract, but in this case I know that the family can not use the days they will have to pay for and am willing to work with them.

    Do you think this is a fair offer?

    BTW mom just emailed me to tell me that I need to back date the start of their 30 day notice because she gave me a heads up that they MIGHT need to give their notice at the start of the month. UM NO.....

    "dcm I respectfully disagree. The 30 day notice will become effective when I receive the notice in writing as our contract states. If, and ONLY if, I find a child to fill the space prior to the end of the 30 day period, I will refund a portion of your fees."

    NO. Then to demand you to shorten the period after your generous offer? no.

      I'm not understanding what the summer schedule has to do with this issue?

        Yes, I was very shocked by the email that she just sent. JUst as she will be hardened by the required payment, I will also be hardened by it too.

        NOw I feel like I shouldn't have even tried to be nice and offer that in the first place.

        This family has been fantastic and then the true colors come out.........guess it's a good thing we are parting ways.....I just hope that this does not get ugly.

            it doesnt have anything to do with anything in regards to me and my program.

            I am just wondering if DCM thinks that because over the summer I allowed for her to pull her child and take the summer off and come back in the fall with no fee, she is thinking that I will allow for it again. HOWEVER, she did give me a 30 day notice back in the start of summer that she wanted to do this. I told her pay for her spot or I will fill it. She asked if her friends child could attend in her place and only stay for summer I said if the child and parents are a good fit yes. It actually all worked out very well.

            So again the summer has nothing to do with me, I just think that maybe DCM is thinking that I will do that for her again.

              Just because she said she MIGHT do something, doesn't mean she will do it. If it benefits her, then she thinks the notice is at the beginning of the month, but had you taken it as official notice and had someone ready to start next week and she didn't end her contract, she would be pissed at you for filling the spot on a "maybe" situation. Geez, you just can't win with some parents. I agree with above posters. Thirty day notice starts when she gives an actual written notice and she is responsible for payment until the spot is filled. And she should be happy you gave her that option, because she could be paying for the spot, not using it, and you could still have it filled and be making double the money.

                I think you are probably right.


                Wouldn't change how I handle it though. Follow your contract.
                If DCM doesn't like it, that's on her.

                  exactly. BUT being that she tried to give me a heads up, I wanted to try and work with her. I didn't have to offer that, but I did only because I know that she was trying to work for me.

                    so dcm threw a fit and I told her that I offered a deal, and she can take it or leave it. However, either way 30 day notice is required and if you don't want to take me up on my offer then I will expect a full 30days payments.

                    and called it a day!!!!
