    Help With Term

    Help me write this term letter please!
    dcf and I have had some respect issues going on lately. I hold them to my policies, but they whine and complain about them (that's gone on for the past few weeks). They TRY to get out of paying, but again, I have held them to it. It's made for a stressful and resentful working relationship and really, I'm just done. We've had multiple disscusions over giving me their schedule (they have rotating days...never will accept this again without paying the full time rate) and it's now Monday and I have no idea if dcb will be here this week. I haven't asked them because I don't feel like I should be the ones to track them down. So anyways, all of this and their kid isn't exactly easy, no more.
    So, this is going to be my offer:
    They need to pay their weekly rate for the next 2 weeks (this is in our contract, any change to part/full/drop-in care requires two weeks notice. I didn't want them saying "oh we only need one day this week! we'll pay the drop in rate!" and then the next "oh we need 3 days this week, we'll pay your part time rate!) and then I will write up a new contract switching them to drop-in care.
    Or:
    They have 2 weeks (actually 3 because the week of Christmas is their vacation week) to find new care.
    So help on making that sound professional, and FIRM. I am not negotiating this with them.

    This letter is to let you know that I will be writing up a new contract (on such and such date) to switch you to drop in care. With your changing schedule, drop in care makes more sense.

    Because of the two week notice policy, the next 2 weeks (add dates) will be the regular weekly rate that you pay now. On week 3 (date) we will be starting the drop in care contract.

    If you have any questions, please let me know.

    Your provider

    I don't think I would put in the "or else find new care" unless and until they reject the above. Then I would say "Sorry this isn't going to work for you. I require 2 weeks notice for withdrawal, etc. (and whatever your policy is)." Then state what day the last day of care will be.

      I like this letter.
      But I don't think I would say the current attendance/fee schedule isn't working....
      I would say THEIR inability to follow what was agreed upon when enrolling instead because what they originally agreed upon was okay with the OP. If I read the OP correctly, it's the failure of the family to do what they said they would originally do (submit schedule/pay for certain days etc) that is bothering her.

        I did agree to rotating days (so, so, regretting it now but regardless I did say it was ok). They were supposed to give me their schedule by Sunday at the very latest so they haven't followed through with that. But, it is also true that this type of schedule really isn't working for anymore and is causing me to loose money since I can't take anyone else in. I can't even have drop in kids because I never have any notice as to when dcb will be here. So yeah, it's kind of both .

          As of (two weeks notice), I am changing to fixed schedules. I understand your schedule requires rotating days, so I will be implementing a drop-in contract for DCK. If you would rather choose to remain on the permanent schedule, the FT rate to hold all 5 days of the week is $. Please understand that drop-in availability is not guaranteed, and must be paid for at time of scheduling.

            I debated offering them to pay the full time rate. But then it REALLY worries me that I will have their child 5 days a week and oh my goodness, I'd go insane . It is so not worth the money .
            Anyways, this term is not going well. They are not happy, trying everything to get a second chance (really way more then a second chance). Standing my ground but really, I'm not sure what part of "Our agreement is no longer working for me" they don't understand...

              I'm sorry, I forgot you wanted to just plain term them. In that case, simply

              Dear DCF,
              As of <date>, I am no longer available to provide care for DCK. It has been a pleasure working with you and I wish you the best in finding new care.

              Then just explain that the rotating schedule is no longer working with your scheduling and leave it at that. Let them know, if you wish and they keep pressing, that you had found a rotating schedule doesn't work for you and that you understand it is their work schedule but you can no longer provide that option, and "good luck!" Give them a referal number if you can, for your licensing office or whomever handles those referrals and count down the days!!

                Thank you! They are still at it, saying it's a "misunderstanding" when really it's not. I have a feeling drop off/pick up could be difficult for the next two weeks and may be saying "I am not willing to discuss this further." Over...and over...and over again. *Sigh* But, then I'll be done with it and them and hopefully get in a more respectful family!
