To me, the "guilty" only assumes that they did commit the crime they are charged with. "But by reason of insanity" (to me) assumes that they are not fully responsible because of their mental state.
I agree that some people are consciously evil, though I have always been opposed to the death penalty. Some days, though, I fear we are reaching some kind of critical mass in regards to the evil
