    You said you can not loose this family but you do realize that if you call the police they will most likely pull the children because they are mad at you .

      We were playing out front at pickup. Yes, a leagally, unregulated(now) in home child care.The kids prefer our front yard for running the back is very sloped.Thanks again.

        I disagree with your Sheriff's Department. While they may enforce the laws, they don't necessarily know all of the liability laws....kwim?

        I found this on Tom Copeland's blog:

        "One day a parent is picking up her child from your family child care home or child care center when you notice one of the following:

        * The parent smells of alcohol

        * The parent does not have a car seat/the proper seat for her toddler

        * The parent is barely awake, or is acting erratically

        You face two potential risks in these situations. First, if the child is injured in a car accident on the way home, you could lose your license. This is because child care providers are mandated reporters of child neglect, and the child in these situations is at risk.
        In addition, if the child is injured the parent could sue you money for failing to take steps to keep the child safe. Yes, it could happen and if it did the parent would likely win some money from you or your business."

        So, if you ARE a mandated reporter (even if legally unlicensed) you COULD be responsible for the parent not having the proper car seat when leaving your care.

        I also found this agreement you could print and give to the parent....it lets them know you are a mandated reporter and HAVE to report when they do not have the proper restraints for their child(ren).

          Once again thanks for all the input. I copied the form on Toms site and it will go out with Jan. updated contracts.I will insist they bring back signed contracts and will make them all their own copies...........so they can refer back to it as needed.

            Staff at centers and family child care providers are mandated reporters of child neglect. That means reporting a parent who doesn't use a car seat. If you don't know that the parent didn't use a car seat (you don't see the car) then you are not liable if something happens. But, if you know the child is not in an approved car seat, and there is an accident on the way home, you can be held liable and potentially lose your license for not taking reasonable steps to protect the child.
