    Staff-Child Ratio - What’s The Staff's Responsibility If Not Being Met

    Can staff members get in trouble for not reporting staffing violations (not enough staff per the amount of children in the facility) to the local agency/state?

    In my state, YES. Especially if a child gets hurt because of it.

        Yes. I believe they can.

        It's a safety violation and one that should ALWAYS be reported.

          Thanks everyone. That was what I was thinking. I was asking this for a close friend who works at a daycare and was telling me about it. I raised the question that if an inspector would make a surpise visit during a time when their boss (the day care owner) doesn't want to schedule the proper number of staff, could the on duty staff members also get in trouble by the agency/state, beside the day care owner getting in trouble.

            Welcome to the forum!! What you should always do if you are out of ratio or the teaching staff is out of ratio, is to report it to the director and/or owner, to always alert them to the shortage. If state does a Pop-up visit as long as you have reported the shortage to the director/owner it's no longer your responsibility. If you don't inform the director/owner then it may become your responsibility and state most likely will ask if you informed them.


            If you see that ratio is out, yes you can anonymously call state.
