Holding A Spot For A New Baby

I am getting ready to have 2 moms sign a contract. Both have a child that is enrolled currently.
One of them will be paying me $40.00 per week effective 1/1 to hold teh spot until April. the $ is non refundable.

Does anyone have a "holding spot" contract they can share with me? I have NO CLUE how to word it.

My email is tara7815@gmail.com if you aren't able to post it.

I have to get this in writing asap

Dont know if you got it yet but something like,..

as per our agreement, payment to hold a spot at my daycare until care is needed is $40 per week. This money is not refundable should you decide not to use my services for your child. This agreement can be canceled at any time by either party with 2 weeks written notice but will remain in effect until either canceled or replaced with an updated contract.

      I didn't get it

      And thank you

What happens if they don't cancel - do you apply the monies towards care? Because I don't want this to be refundable - is that normal?

that money is to hold that spot,.... just like if they were going to be there,... each week 40 is due and if they dont pay, they lose the spot, you interview and fill it and their money they paid is gone... it isnt applied to crap. Its yours for holding open a spot for them that you could fill with a full paying client. You are doing it to be nice and help them out,.. never forget that.

Here's mine. You would have to word your a little different since you are charging current clients and I do not.

Only full time positions may be held. Current clients may hold a spot for a new infant without payment of this holding fee as long as their older child(ren) are enrolled full time. The holding fee guarantees that I will keep a spot open for your start date. It does not guarantee that I will have your spot open before your start date. Holds do not start until paperwork has been signed by both parties, a start date has been agreed upon, and initial payment has been made. The two week trial period begins when the child begins care full time.
The holding fee is $80 per week to be paid weekly or monthly in advance.
For an infant (up to 12 months) hold, I require that the infant visit with a parent at least once a week for ½ an hour during the 3 weeks prior to care starting to aid in the transition. The parent is not to leave during these visits. These visits will be scheduled between 9am and 11am. If parents fail to show for a scheduled visit the hold will be considered canceled by the family.
If the family cancels the hold before any care is given, any paid holding fees will not be refunded. Any late payments will result in a late fee being added per polices. If payment is overdue by a week then the hold will be considered canceled by the family.
If the provider cancels the hold before any care is given, any and all holding fees will be returned after the checks have been cleared by provider's bank.
If the contract is canceled in the two week trial period, by the parents or the provider, no holding fees will be returned.

I agree to the terms of this holding fee addition to the policies.
          Signed _____________________________________ Date ____________
          (child care provider)

I agree to the terms of this holding fee addition to the policies.
          Signed ______________________________ Date ___________________
          (parent or guardian)

            Thank you for your help.
I just wanted to make sure that the "holding fee" isn't being applied towards their tuition once the infant starts... it is just mine - period.
