    WWYD Terming issue.

    so the family that I was posting about that was complaining about my 1.5 mile move and not wanting to pay the additional fees for over time hours, well I gave them term notice Wednesday.

    OH BOY this one is not going to be pretty. I can already smell the drama.

    My contract states that you will have 30 days to find new care when you are termed and you will be responsible for the full 30 days of fees whether your child is in attendance or not.

    My client pays monthly and DCM paid Monday. They do have a deposit which I will apply towards the last two weeks of care. So I will owe her money, however, I normally never give it until they leave and we have parted ways making sure that they don't do anything that cost me money while here. LIke late pick up, over time hours and etc.

    Well this DCM is demanding that I give her back her deposit now instead of at the end of their stay. I looked in my contract and it is not discussed. UGH I hate this when I have to add more stuff to my PHB

    WWYD??? I have never had this happen before. I know she is mad and being childish, I don't really want to start issues, but I also don't want to give her back money now that I may have to go back and chase down later.

    IDEAS???

    I would explain to her the reason for holding it and hold it whether she likes it or not. If she wants to walk then she pays for time she is not using.

      IF the deposit is for the final two weeks of care, then she is not entitled to that money (or whatever remains) until AFTER the final two weeks of care.

      I know she paid for the month already but I would just tell her, once the final day had ended, the balance will be calculated and the overage refunded to her (via check or whatever you do) AFTERwards.

      Your contract doesn't have to spell it out.

      Just tell her it says applied to the last two weeks of care. Which is what you are planning to do.

      If she argues that she already paid, just tell her you know but that was just the way the timing happened and there is nothing you can do about it until her final bill is calculated and her account is closed.

      No refunds for overages until the account is closed. Simple as that.

      Just like renting. Your deposit and any overages are paid out to you AFTER the lease is over and you have moved out.

        Just tell her you will return it if she agrees to remove him now and does not get the month pay back. If he stays the month you need it until the last minute he is there. Tell her you have had clients be VERY late the final day of daycare so you need it for late fees.

          thanks ladies. Here I am thinking I need to re-word my PHB again.

          I will make sure that I affirm that it will be applied to the last 2 weeks.

          BC- good way of looking at it. Just like renting a house, you dont get deposit back until after you move out. I will use that when I tell her.

          Nan, I am so tempted to do what you said. I have another family waiting to get in and it's at the rate you told me to.

          BTW I am putting out all of my increase notice by pick up time scale on Tuesday9/2.

            Agree with previous posters. She wants the money back so she can use it as a deposit on finding new care and is mad because she probably doesn't have it available otherwise. A financial emergency on her part does not constitute an emergency on yours Edit PHB to make sure it doesn't happen again.

                You could simply add under your deposit discussion in the handbook:

                "Any monies owed to client at the end of care - including but not limited to deposits and over-payment of fees - will be returned to client on final day of care provided."

                or something of that nature.
