    Q: Friend Situation

    I have a friend who had an issue and CPS was called a couple years ago. During a TWO year investigation for various things, she was visited, went to court and a whole bunch of other stuff and had to meet certain criteria before they would allow her to parent without assistance. The case was finally closed in April. After a beef with a so-called friend, she stated that the caseworker on her former case called her out of the blue stating that to "close the case" she'd need to see the kids with her own eyes. Then she said a few other things as well. My friend went to check and make sure the case IS closed and it IS. She wants to know:

    IF the caseworker contacts her again, what can she say?

    I'd ask for proof from whomever handled her case that it's closed.

    If it's the same caseworker that's calling her now, your friend could go to a supervisor in that dept and ask.

    Either the case is closed and the worker is harassing her or the case has an extension on it for follow-up every so often, even if it's technically closed.

    I had a DCP that had an open case. Once everything was resolved the case was closed but human services stated a follow up visit was to be done every 12-15 months for 3 years afterwards. So something like that could be the reason.

    Have your friend call and ask who ever was assigned to the case. Or a supervisor.

      I am the friend in question here. There were no conditions placed and the case in fact closed as of march. I have the court documents stating the case was closed since march. The family preservation worker is trying to say it hasn't been closed on their end and that she needs to com into my house and officially close it. I don't think she can legally do this because I have proof the case is closed. Am I wrong? THanks/

        I would call and ask someone higher up at CPS to be sure.

        I want to say the courts have the final say but if CPS is the party that initiated the case against you, they may be right about closing their end on their own time.

        The criminal or judicial part of the case (court) may be closed and over with but CPS may still have some validity in keeping their end open.

        I'm not positive and only familiar with laws in my state so honestly, I think the only advice I can give is to call someone (either a family lawyer in your state) or someone higher up at CPS to know for sure.

        Since it involved your children, do they (the kids) have a guardian ad litem or separate case worker that was assigned to represent them? If so, I would definitely call that person.

        I would not just take what the case worker calling you is saying at her word though.
