    My husbands grandma is having surgery today, he took a 1/2 day off and was going to get off at 5. His department has to have at least 3 people working at night. The scheduler forgot to put in someones military training leave months ago. Understandable. Then this one woman has FMLA for depression, she asked the boss to take a half day so she can go out to the bars with some friends. Her request was denied since too many people have it off. She told her boss fine I will just use FMLA. By law they can't deny her using it. So the boss had to take away my husbands time off to go to the hospital, since there won't be enough coverage.
    The woman abuses FMLA all the time! On average she will call in 3-4 times a week, then at least once a week she will come in, go to lunch then call the boss and say she isn't coming back and using FMLA. It is so frustrating! There are only 5 people on his team that work nights and there are about to change the rules to 4 people must be working at night. So it will make it nearly impossible for him to get days off. This has happened to my hubby way too many times! He needs a day off too! The employers can't do anything about it, if they fire her, she could sue them.

    Just want to clarify I don't have a problem with people using FMLA if they aren't abusing it! Hubby had it last April for when you LO was in the hospital for a week.

    There are limitations on FMLA, it can't be used just unlimited for no reason. She only has 12 weeks in the year. She also has to work 1250 hours to qualify for leave according to the department of labor in the preceding year, so she will run out of FMLA at some point. So if she exceeds that, she can very well be fired. Besides she can be fired without cause unless she is a contract employee. So there are legal ways around it for the employer.

    That being said, I hope your husband can get time off, it sounds like he deserves it!

      Sounds like your dh needs to come down with a violent stomach flu this afternoon.

        Is she getting treated for depression. http://benefits.iowa.gov/fmla.html.
        They can require a medical certification. I don't think drinking is okay with most anti depression medications.
        She may indeed have depression, but going out drinking makes it worse, and she should be seeking treatment.

            I hope so too! I'm not sure how she is slipping by?

            I told him he should do that but he doesn't have any occurrences and wants to keep it that way.

            Drinking on most medicine isn't good!

            it is Family medical leave act, I don't know the ends and outs of it. But if you have a medical issue it gives you time off work without getting in trouble with the employer or lossing your job. It is valid for 1 year, if you still need it you need a doctors note to renew it. She is friends with a doctor, which is why it keeps getting renewed. IMO.

              Pretty sure going to the bar drinking is not covered under FMLA Does she have a doctors orders to do this If not pretty sure that appointment does not qualify.
