If the defendant rattles off the bills they owe, I remind the courts this is a bill they owe as well & it should NOT come behind a cable or cell phone bill. I can also put a lean on real estate, cars, jewelry, etc. Every time I return to court they are charged with court fees. Interest on the amount begins the moment the judgment is given.

    I own rental property & unfortunately well versed in our court proceedings. I hope this helps...

    I live in Indiana too and have a family that we will probably take to small claims court for money owed. We had another family that we tried to do this to but they went bankrupt so we couldn't get our money

        Glad I am useful!

        I used to try and be a people pleaser.... I learned a long time ago (and the hard way) that people, ourselves included, really do need to look out for number #1 FIRST and let the rest fall where it may.

        This can be the most rewarding, most fulfilling profession ever if YOU are in charge. If your clients are running the show, this job can be someone's worst nightmare.

                    In Indiana the debt must be a part of the bankruptcy proceedings in order to be discharged. If they file on a debt, the person or company they owe must be notified so they can attend the hearing & show reason why it shouldn’t be discharged. Just because someone files on a debt, it’s not automatically discharged. The bankruptcy judge can choose NOT to include it.
