    Termination Question

    1. Parent lost job 12/22/13
    2. I gave leads on jobs.
    3. Texted parent 12/31/13 for job status & she didn't reply.
    4. Texted parent 01/03/14 of child status for reporting to state. She replied she was "good." I rephrased I need to know if child was registered, withdrawn or terminated for my monthly report. She did not reply.

    I am terminating today & contract states a two week notice. Contract states "If your child(ren) will not be attending childcare for whatever reason, you are still required to pay."

    My question is do I charge her just the two weeks or the entire time? I value everyone's opinion..., thank you!!

    ps.., Good kid, good parent relation until this.

    I would charge what she is supposed to pay-the whole time.

    If I had an immediate replacement though, I would terminate, but not charge past the termination date or the date the new child is starting. That's just me.

      What do you mean by the entire time?

      Have you provided services up until the termination date (today)?

        No, she hasn't been here since DCM lost her job on 12/22/13. My policy states: It must be understood, to hold your child's space, payment must be paid whether your child attends or not. Payment is based on contract, not attendance. Our contract requires a two week notice.

        DCM hasn't contacted me to inform if she was ending contract or what. DCM did not inform me she lost her job the day it happened. On that day, I texted & asked if DCG was coming to DC & she replied, "No sorry I forgot to tell you." I texted two days later (on her next scheduled workday) & asked if DCG was coming to DC, again. DCM replied she was fired two days ago. (on the 1st day I texted her btw) She has not been to DC or indicated she wants to terminate services. She did NOT reply to my question of DCG status in DC either. What would you do Blackcat?

          I would bill her as an enrolled kid up until tomorrow's date.

          I would terminate the contract as of Friday, January 10, 2014 (just to end the week nice and neatly) and then bill her for the final two weeks of care (Jan 13-17, 2014...first week/January 19-24, 2014...second week) and call it good.

          That is what I would do.

            Thank you. I felt the same way, but needed to hear it from someone else. I think the holidays made me a temporary softy...

              Unless she said she was terminating/stopping/withdrawling etc., your contract states that she is paying for childcare regardless of her child's attendance. Moreover, it sounds like she was trying to avoid you so she didn't have to pay the 2 weeks of fees for the 2 week notice. I would text/call her: "Your child is still enrolled here since you never told me to withdrawl her. You stated you were fired but not that you were no longer keeping your childcare spot here. There is a two week notice with fees in our contract, there are no exceptions to this fee. Since you didn't tell me that you were not keeping her childcare spot, you have continued to accrue fees since 12/22. I have tried numerous times to contact you but I have received no response that told me to permanently terminate her care. Would you like to continue your childcare or terminate your spot? If you choose to terminate, your fees are $XX. These are due immediately and if I do not receive payment (or maybe offer a payment plan), I will be filing with small claims immediately.

              Sadly, I see this one going to small claims if you want your money. She isn't going to pay you when she doesn't have a job - and her avoiding your communication is VERY indicative of that IMHO. I suggest documenting all your texts/contacts with her to prepare.

              Again, just my opinion :hug:

                    In our town the judge automatically garnishes wages for a judgement. If the person doesn't have a job, they pay $25 per week regardless. They then have to return to court in 3 months for an employment update if they haven't notified the courts of their status. They have additional $96 court fees for this. They also have interest tacked onto the balance in the meantime. I only wish they could put it on their credit report!!
