Daycare Area On Second Floor

Hi I'm planning on opening a daycare in California, we are building a house with a very large bonus room on the second floor do they allow
This? It would be very easy to protect the children from the stairs by gating it. Thank you!!!!

I am not in CA, but we have a lot of providers who are - and I am sure they will be chiming in shortly.

Where I live, we can't use upstairs areas for children, because of fire safety reasons, not so much the actual stairs being a danger.

I used to live in CA. If I remember correctly you can not use your second floor unless it has a direct exit outside. I may be wrong and I'm sure our many CA providers will weigh in.
