    Immediate Termination?

    I have terminated before but thankfully I have never had to terminate someone immediately so I am a little out of my comfort zone. I have in my contract that I am able to terminate immediately. But it doesn't state the reason I need. So I don't know if I can term as of tonight.

    Situation:

    Dcb (4.5) has been here 1.5 years. Mom lost her job 5 months ago and was using assistance to pay me but they stopped helping her now. So she moved to 2 days a week, giving me 2 weeks notice. She then started sending dcb to preschool since they offer it for free and her words "I can't handle him, I am sending him to preschool to keep my sanity" then without notice changed it to 1 day a week (preschool only 4 days a week) This DCM is easy to get along with but not as a dcp! She has a hard time following rules and think they don't apply to her. Dcb has always been a little on the wild side but nothing too bad. Since starting school it is like a 180. He has been extremely difficult. Dcb put a toy down and my DS then picked it up. Dcb was very upset took the toy away and hit DS with it and cutting his forehead open. Dh was home and took him to the doctor. DS now has stitches. With so many problems with this family I would just like to be done and not deal with it anymore. Since my contract (currently) doesn't cover this do I have to give 2 weeks notice? Another problem is the family lives 3 houses down. So making it even more difficult. As much as I would like to "let loose" and tell them everything I feel and what went wrong I'm afraid to do that since they live so close.

    IMO, if there ever was a reason for immediate termination, this would be it. If your contact says you reserve the right to terminate immediately, i would definitely term this kiddo. Hugs for your poor son.:hug:

      I agree. He is a danger to the other children. I would make sure mom knows that you are concerned about the whole group and not just terming because it was your son. Not that it matters, really. If a child is a danger to the other children, they have to go. No way would I put up with it, especially if it were only 1 day a week! :hug: to you all!

            He has become a danger! The contract part is what I am most worried about. It states that I can terminate immediately for non payment. But I don't have anything for terminating without notice for a child's behavior issues. Which I am in the process of changing right now! I didn't even think to have that in my contract since I have never come across this issue before.

              Everything is a lesson learned and I hope your ds is ok now I would add that you can terminate at any time, for any reason. I have NEVER had a parent question that and it is in my contract.

              I would give her a term notice, two weeks and then during that time (2 days, right?) I would have dcb shadow me and not leave my side to prevent any further injuries JUST IN CASE. I would just hope she would be mortified enough to leave and not come back.

                Considering that he is now at one day a week attendance (with NO notice) I would categorize him as drop in.

                Drop in means NO reserved space and can only attend IF I have availability.

                I would maybe go that route...

                  I think in your case this is what I'd do. I'd also make it clear to mom that for those last 2 weeks he'll be your shadow and basically kept separate from the others. Knowing that she'll most likely not return.

                    Since she moved to 1 day a week, do you have a new contract? If not, the old contract would be void since she changed the terms (2 days to 1) and I'd term immediately. If she did argue, I'd just state that she is "drop-in" now that her old contract is voided and is no longer under any contract. Due to the violent behavior and harm to your DS, you can no longer take the liability to watch him, in case another violent incident occurred. Good luck, that is a difficult situation to be in with such a close neighbor!
