    Termination Worries

    So after my DCF pulling Sunday due to my unwillingness to allow their 21 month old to attend in underwear (I require pullups until 2 weeks accident free), NOW my PT DCM text me to say she got fired today.
    Would be bad enough, but I just realized she hadn't paid my deposit yet (I allow it to be paid within the first month) and I have a bad feeling they will try to $crew me over My contract is very clear that I require written 4 weeks notice and will send to collections/ small claims court but I really don't want to have to. UGH!!! I'm down to 1 FT and 1 PT now, I just want to cry
    If I don't hear back from her tomorrow, I will give one more notice before I send a certified letter- but any other suggestions or advice? I can't go without the money, so I will not let the $210 balance just go. Do you know if a text will legal hold as "written notice"? I have asked for a signed, written notice but I haven't got one yet.

    My policy and contract requires my notice to be in writing on paper or it doesn't count. Generally written means written as far as legal is concerned.

    I would notify the mom who just got fired something to the effect of

    "Dcm, please let me know when you can come by and hand me a written notice of termination. Remember, notice is 4 weeks and has to be written. Your balance is $$$$, which includes your deposit of $$$$ and is due by xxxxx or late fees will be included in the additional amount of $$$$"

      So I called their home phone from my home phone and DCM answered. She told me she'll be by with a notice and that she'll use me while she works for her MIL for the same days--- but I don't think I trust that. Hopefully I'm wrong, but I can see her using me next week, since she's already paid for it, then not paying again. Otherwise, why wold she NOT have answered my email or text but told me she wanted services when I called? We have only communicated via cell phones before, so I'm sure she didn't know she was answering my call.
      Just in case, how exactly does collections work? What information would I need to supply if I ever do need to go that route?

        I would get those spaces filled first, and start advertising. Wait and see if you are not paid and go from there.

        As for the underwear parent, I always find out the child is in pull ups at home so their carpet, car, and furniture are not destroyed. I simply put the diapers/pull ups on as soon as they arrive. They can go home in underwear, and do that in their car or home!

        Oh and I make sure to give then a large cup of water 20 min. before their pickup! Often solves the parent problem.

            I would make the parent pay the remaining notice amount before you provide any additional care

                  Imho, I wouldn't ask for it at this point if they have to leave. I think it would come off as shady and underhanded, like you're miffed she has to go so you're going to try to stick it to them before they get put the door.

                  Get it before care starts next time

                        i don't see how enforcing your policies can be construed as underhanded? if she requires 4 weeks why shouldn't she get it?

                          I dont understand the point of a deposit if you allow a full months care before requiring payment? Am I missing something here? I have never heard of this before....
