I have a large inhome daycare. My husband currently is my partner, but he will go back to work durin the summer. I have a friend whose daughter is 14. I have heard that in California you may have an assistant as young as 14 as long as they are not left Alone with the children. This girl is very good with kids and I trust her. I just need some help wih preparing snacks, crafts and playing with the children. If I have her down as my assistant, am I allowed to have my 14 kids? Does anyone know how this works ? Thanks

I think as long as she is not left alone with the kids its okay, but I am not 100% sure. At the place I used to work at she had lots of junior assistants (prior daycare girls between 14-17) who she would sometimes pay to help out if one of the assistants was out or she needed more help but she usually had another adult on site too (she would have 2 assistants working one shift most of the day). The only things she didn't allow the junior assistants to do was:
1] Pick up and carry young children and babies around
2] Assist with potty training
3] Change soiled (#2) diapers; but she allowed them to change wet (#1) diapers
4] Heavy cleaning that involved chemicals (bleach and other cleaning solutions)
5] Anything more than a warning as discipline (ex: they couldn't put kids in time out but adult assistants could)
But I do know that she will not need a work permit (California requires most employees who hire minors to sign one) because it is considered a "domestic" job (a job done in some ones home). I needed one when I worked at Michael's but not when I worked at the daycare.- Flag

She will not be counted as a daycare kid in your ratios. With her as an assistant you can have 14 children. You just cannot leave her alone with the children.....meaning you cannot leave the property. She CAN be alone in a room with them.
You do not need to do a background check. If you are a large license, she will need cpr and first aid.
You will need a copy of her birth certificate so that you can verify her age if asked if licesning visits. You also need to notify your worker that she will be there as an assistant.- Flag

I wanted to share with you something I just found out.
I just got off the phone with my county health coordinator, trying to ask about where I can send my new asst to get CPR/First Aid.
She told me anyone under 18 cannot be left with the children, so they are not required to have the CPR/First Aid, however,she said she highly recommends it.
She said the reason 18 and up have to be certified, was because we as providers can leave them with the chidlren and there always has to be someone there with the CPR/FA cert on the premises.- Flag

Ok I just got off he the phone with licensing. He said they did not need to be CPR certified. (I'm still goin to have her get one) they will not be counted in my ratios as long as she can go home. Which doesn't make sense because If licensing was ever to show up and I have her here i would need to send her home , then I'll be over!?
Also I do not need her birth certificate or anything in her file. I asked.

oh one thing do you know if the still have to fill out the employee forms that licensing requires.
I think they are notice of employee rights, statement acknowledging requirement to report child abuse???- Flag

Since my husband is my partner I don't have workers comp. I didn't know I would need one for the 14 year old so I'm going to have to ask insurance broker about that. I'm going to give him a call today and I will get back to you on that. Who do you have? How much do you pay if you don't me asking.- Flag

they are a horrible company to deal with, but I didnt have a choice when no one else would underwrite for me.
let me know what you find out..............
BTW...please anyone correct me if I am wrong, but I was told that we would need to have wokers comp insurance in this state if we have even 1 employee...............- Flag

You are correct about needing workers comp with even having just one employee. My husband isn't on the payroll so he is not considered an employee. That is what my tax lady told me.
So it it $60 a month per employee? I don't think that's that bad actually, I'm going to have to look into deeper.
