    TERM or NOT?

    DCB goes to dad's. Mom pays. One month later DCB goes to dad. Mom doesn't pay, but pays for next week's care. Sent text to mom reminding her & she doesn't pay. DCB goes back to dad's again with no payment or notifying me he wasn't coming. Sent text reminding her, policy is not per attendance & she failed to notify me DCB wasn't coming again. She states she can't afford it. Offer her daily rate or pay weekly to hold place. She send this text:

    I cant afford that either... And theres been places before when i worked in bloomington that have worked with me on elis dad takig him eery other week. I cant afford what ur asking nor can i afford to pay for him to not be there. So if my contract needs to be terminated then so be it, but i cant do either of what ur askig.


    NOTE: I did not charge DCP to hold her place when she lost her job or when she worked overtime. I was trying to work with her, but it is one sided. Child is going to dad's every other weekend this summer I assume. I was not notified or asked to work with her situation ahead of time.

    Terminate?

      absolutely.

      I would respond with a letter of termination certified mailed to her home effective asap.

      What does your contract say?

        I would tell DCD that if he wants to cover the past due amount that he's welcome to. If not, you will terminate services effective immediately until past due payment is recouped.

          IT READS:
          "It must be understood, to hold your child's space, payment must be paid whether your child attends or not. Payment is based on contract, not attendance."

            We had that conversation & he says that what he pay support for. Sticky situation I guess.

              She is telling you that she can't pay you what she signed to pay. Yes terminate. You can either give her a 2 week notice or you can be extra nice and offer to terminate immediately so that she doesn't continue to accrue the next 2 weeks of care and get deeper in the hole HOWEVER I would require that she pay what is owed up to the point of the termination.

              If she couldn't afford it, she shouldn't have signed the contract. She also could have put in her notice of termination as soon as she realized that she couldn't afford it but she didn't.

              A nice response of ..
              "Okay I understand. Unfortunately as our contract says which you signed my fees are not based on attendance. I will need [a written and signed 2 week notice from you or I can type one up for you and you can sign it today] OR [Normally I require a 2 week notice of termination but I am willing to release you from the contract immediately so that you don't incur another 2 weeks of payments] let me know how you want to proceed. I must remind you however that you signed the contract and agreed to my terms of payment when you did so and so my regular rates are still owed. I know that other programs may charge differently however as it says on my contract, I charge regardless of whether or not the children are in attendance. As of today your balance is $XX.xx and will need to be paid. Let me know if you need to set up a payment plan."

              Then I'd type up a payment plan contract of what YOU want to collect and due dates. Like...

              "
              [date of notice]

              DCP and DC provider agree that DCP will be allowed to pay the DCP's balance owed of $XX.xx in weekly payments of $XX.xx paid no later than [time] on [day if the week] until the balance is paid in full. Based on this payment plan the balance will be paid in full by [month/date/year].

              If payments are not made when due a late payment fee will be added to the balance in the amount of $10 per day. If a payment is not received within 5 calendar days of when due this debt will be reported to collections and court claim may be filed against you in an attempt to collect this debt.

              The first payment in the amount $XX.xx is required on [month/date/year].
              All subsequent payments in the amount of $XX.xx will be due each [day of the week] no later than [time] until the debt is paid in full.

              Provider name: [printed] Provider signature: _____ date: _____

                Thanks Marina! I sent it to her. I'm sure she is still saying what the what? I need to have a stronger stance in these situations. Looking at it in it's totality, I was being more that fair & she was taking advantage of the situation.

                  It sounds like you have tried to be polite as possible and gave her a fair chance to rectify the situation before she got behind. You're doing the right thing here.

                      OMGosh! I took a breather & got some Pepsi Max (my crutch). I stood there thinking I just took a pay cut. The phone rang & it was a lady who came out a month ago with two children. They decided they want to use my services & will be by tomorrow to sign the contract!!!

                        That is AWESOME!!! Now regardless of what the other DCP decides you won't have an interruption in pay. I'm so glad to hear it!

                        How much does the 1st family owe you BTW. Just out of curiosity?
