    Quick Question About Capacity In California

    My daughter is divorced and she and her 15 month old (my granddaughter) live in my home, but up until now, the baby has only been here on Mondays and Tuesdays during the work week. The baby has been at her Dad's house on W, Th & F.

    Now my daughter's custody may be changing and the baby may begin living here with her M-F, but she would be attending daycare full day at another center - not here in my home.

    Does anybody know what the rule is about counting a child under 10 who lives in your home but is out of the house in care elsewhere during my business hours? Would I still have to count her in my total head count just because she lives here?

    The child counts in your ratio when they are physically present in the home. Even though she may be at another provider the majority of the time, you may still want to count her as though she is there all the time. What happens when the other provider is closed, or your granddaughter is sick? In those cases she would be home. Even though my daughter is in school all day, I still count her as though she is here because of those times she may be sick, or school is closed etc.

      As all the other kids, she only counts when she is there.

      But like the pp said, I would count her in my #s if there is a possibility that she will be there at any time.

      I count my grandson even though he is at school most of the day.
