    Received Citation For "Daycare Room"

    Good Morning,

    I am seeking some advice for an issue I am currently having in regards to a recent citation I received from licensing.

    Last Thursday, I received an unnanounced, random visit from my new licensing worker. I have been a provider since Jan 2001. During my pre-licensing, I requested being able to utilize my attached garage for a playroom for the kids. The garage at the time was finished, but, needed paint, carpeting, and a covering for the water heater and furnace. The previous owners of our home had already had heating/air conditioning piped in, as they used to put their dogs in the garage while at work. She said this was new territory for her and would need to speak with their legal team about garage use. She contacted me back and said that the legal team was fine with it as long as I made some type of barrier so that the kids were unable to physically touch the garage door. We had this done, including new carpeting, new windows and a ceiling fan. This specific licensing worker never came back out to ensure it met licensing standards.

    About 3 years later, I received an unnanounced visit from another (new) licensing worker. She asked me about the room use, I explained it was solely for playing. My dc kids eat in the kitchen and nap in other bedrooms. I explained what the previous worker had said and what was agreed upon. No citations were provided. This same worker came out in 2010 for yet, another annual unnanounced visit. She again never said anything about the room. It wasn't until I questionned the possibility of expanding and applying for my large license. She said I would need to have the room "permitted." I declined proceeding and the room was never an issue.

    Just last week, (2 years after last visit) a new worker showed up on my doorstep and proceeded to cite me for the room not having a permit. She said she would give me only 30 days in which to rectify the situation. I argued my point that I have been operating ou of this space for nearly 11 years and it has never been an issue. She threw the regs in my face and circled it.

    It is unclear to me how to obtain a permit in California for a room meeting daycare standards. In fact, this area is very grey!

    Has anyone encountered this before and if so, can you please advise how I go about obtaining the necessary permitting requirements?

    I met with a contractor the day after whom said he would speak with the building inspection department, but as of today, he hasn't contacted me with any information

    You have contacted the right people, you just need to wait to hear back from them. What county are you in? I may be able to help you find the exact info you need. Here is the licensing reg for garage conversions:

    102416.3 ALTERATIONS TO EXISTING BUILDINGS OR GROUNDS
    • The licensee shall notify the department of proposed changes to a Family Child Care
    Home including, but not limited to:
    Garage conversions into a “child care” room; room additions; installation of inground
    or above ground swimming pools, spas, fish ponds, decorative water
    features, fountains, or other bodies of water; construction of exterior decks or
    porches; construction of play equipment including swing sets/climbing structures;
    and any change of “off limits” areas.
    The licensee shall provide the department with a copy of an inspection report when
    an inspection is required by the local building inspector as a result of the alteration,
    addition or construction.

      we are in sacramento county. i have that same copy of the regs...just wanting to know exactly what needs to be done in order to obtain the necessary permit.

            I posted earlier but a baby turned the computer off on me.

            Contact your local code enforcement.

            We converted 1/2 of our 4 car garage into a playroom for the daycare. 1st analyst, not an issue. A neighbor called code enforcement and said we had family members living in our garage. City came out and inspected, all was well because my dh had put up a retaining wall, no electrical, no water. Neighbor called in again a few years later, again saying we had family living in the garage. By that time, I wasn't doing daycare and the area was full of whatever. A young girl with a tiny bit of power made an issue and we had to pull permits, tear parts of both sides of the wall down and have everything inspected. The inspector started nitpicking everything and dh told him that he used to build houses and he knew everything was up to code. The inspector wanted my dh to tear it down and use nails whereas my dh had screwed everything together. Also, we applied to use the area as "storage" as we were told they would not approve it for a game/playroom. Imagine our surprise when the city change the permit to a game/playroom. We got our permits AND a bill from the county raising our taxes.

            When I reopened my daycare a few years ago, I had to send in a copy of the permit. I also had to physically show the analyst the orange permit card.

            According to our city code enforcement, you cannot convert a garage to a living space unless you have another garage. You have to have at least a single car garage.

              Check with your code enforcement. In my area (Ventura county) you have to replace your garage with another garage or carport.

              I'd call licensing now and request an extension now in case you can't meet the deadline. 30 days to me doesn't sound to be a reasonable amount of time to get everything in order.
