    License or not

    Tom this question was posted on another section of the board.

    What are the rules for a situation like this.

    We aren't sure if they need to get a license (MN rules say she needs one for more than one family) but since there is no money changing hands, we are wondering what the rules are for this and if you have any additional info that might help. Thank You!

    The Minnesota rule says that daycare is "care of a child in a residence outside the child's own home for gain or otherwise, on a regular basis, for any part of a 24 hour day."

    So, it looks like a provider would still need to be licensed even if she wasn't paid.
