    Another Landscaping Question, Tom!

    We use our back yard a lot for daycare. We have a 2 story walkout, and under our deck is where we store our outside toys and riding things. It is a dirt hill (our patio is a lower level than the other side of our yard, so the slope is big) that runs to the side of the patio. Anyways, when it rains the mud comes down and covers the patio. Plus, the toys get muddy. We're thinking of redoing it to get at least pavers or something to keep it maintained better and keep the toys and patio from getting muddy. Would we be able to claim a T/S on that and depreciate? Thanks Tom!

      If you put up a retaining wall, it's landscaping. Such landscaping could be deducted (use your t/s%) over 39 years if it is close enough to the home that it would be destroyed if the home was moved to another location.

        Thanks Tom! What about if we just dig up some of the the dirt and pay to have concrete laid, to have more usable patio and storage space? How would that be claimed- the same way?

          Putting down some concrete would be considered a land improvement that you would depreciate over 15 years.
