I don't have an assistant but I think you might find the answer to your questions in Tom Copeland's blog as he has a couple really good articles about paying assistant and tax responsibilities

You must treat this person as an employee, not an independent contractor. This means withholding Social Security tax, paying federal and state unemployment tax, and perhaps purchasing workers compensation insurance. I've discussed how to fill out all the federal tax forms in my book Family Child Care Tax Workbook and Organizer, or look at my blog for additional articles: www.tomcopelandblog.com.

If I am paying some one less than 120.00 a week, do I still have to do the withholding? I read somewhere that for people that make certain amount they don't need to do it? Does this include SS?

You must withhold and pay Social Security/medicare tax on the first dollar you pay an employee. There is no minimum wage where this is not required. See my blog article: Does Paying Someone Less than $600 a Year Make Them an Independent Contractor?: http://www.tomcopelandblog.com/2012/...ontractor.html
