Can You Have Daycare On Second Floor?

Can you have daycare of second level of home? We are building a home with a large bonus room. Thank you!

I do daycare in our apartment which is on the second floor. Where I live in Wisconsin, that is okay as long as you have two exits leading to the ground floor or a balcony. So for us we have a stairway leading to our front door, and a patio door leading to a balcony.
